Pool Pre Cert (PoolPreCert) · ABN 22 916 588 904 · registered for GST · support@poolprecert.com
1. About these Terms
These Terms of Service (Terms) govern your access to and use of PoolPreCert (Platform), operated under the registered Australian business name Pool Pre Cert, ABN 22 916 588 904 (PoolPreCert, we, us or our). By creating an account, accessing the Platform, purchasing a subscription or otherwise using the Platform, you agree to these Terms.
If you use PoolPreCert on behalf of a business or other organisation, you represent that you have authority to bind that organisation.
2. What PoolPreCert is
PoolPreCert is a software and information service. Depending on the features available to you, the Platform may provide self-check workflows, educational material, AI-assisted image or information analysis, reports, property records, reminders, professional tools, and a directory or review functionality for pool-safety professionals.
PoolPreCert is not a government agency, building certifier, pool safety inspector, legal adviser, engineer, surveyor or other statutory authority.
3. No pool safety certificate or statutory inspection
A PoolPreCert self-check, report, score, flag, image analysis or other output is not a Queensland pool safety certificate, non-conformity notice or statutory pool safety inspection. PoolPreCert does not authorise a user to represent that an AI result or self-check is a statutory inspection.
Only an appropriately licensed Queensland pool safety inspector can issue a Queensland pool safety certificate where the law requires one. Users must obtain professional inspection and certification where required. See QBCC: Inspect and certify a pool.
4. AI-assisted features
Where the Platform uses artificial intelligence or machine learning, outputs are generated from the information supplied to the Platform and may be incomplete, inaccurate, outdated or wrong. AI may fail to identify a hazard, may identify a condition that is not actually a defect, and may not be capable of reliably determining measurements, gate and latch operation, barrier strength, hidden defects, site-specific construction issues or every legal requirement.
AI output must be treated as an informational pre-check only. It must not be relied upon as the sole basis for a decision to use a pool, alter a barrier, certify a property, represent legal compliance, or determine whether a statutory obligation has been satisfied.
5. User responsibility
- You are responsible for the accuracy and completeness of information you provide.
- You must physically inspect the property and seek appropriately qualified advice where necessary.
- You must not represent PoolPreCert output as a statutory certificate or professional inspection.
- You must comply with applicable laws, regulations, local requirements and directions of relevant authorities.
- You must keep your account credentials secure and promptly notify us of suspected unauthorised access.
PoolPreCert is not engaged to physically inspect, repair, maintain or certify your pool barrier. You remain responsible for taking appropriate action where a potential safety issue is identified and for obtaining professional inspection or certification where required.
6. Property photographs and uploaded content
You retain ownership of photographs, documents and other content you upload, subject to the licence below and any rights of third parties. You grant PoolPreCert a non-exclusive, worldwide, royalty-free licence to host, reproduce, transmit, process and display your content to the extent reasonably necessary to provide, secure, support and operate the Platform, generate requested reports, perform requested AI analysis, prevent abuse and comply with law. PoolPreCert may use aggregated or de-identified information to analyse and improve the Platform, but will not use your identifiable uploaded content for general-purpose AI model training except as expressly disclosed and permitted under the Privacy Policy and applicable provider terms.
Do not upload unnecessary personal information. In particular, avoid photographs containing children, other identifiable people, vehicle registration plates, identity documents, passwords, access credentials, alarm/security codes or unrelated private information.
7. AI and third-party technology providers
PoolPreCert may use third-party infrastructure, communications, payment, analytics, storage and AI providers. Depending on the feature and configuration, content may be transmitted to those providers to perform the requested service. Some providers may operate or process information outside Australia. Our Privacy Policy explains this in more detail.
8. Directory and reviews
Where PoolPreCert provides a directory of pool-safety professionals, a listing is not an endorsement, guarantee, accreditation or representation that the professional is suitable for your circumstances. You are responsible for checking the professional's current licence status and suitability.
Asking a listed business to contact you is not a booking, a quote or an inspection, and PoolPreCert does not promise that a business will join PoolPreCert, receive your request or reply. If a business has not yet joined PoolPreCert, your request waits for up to 60 days and nothing is sent to the business until it has claimed its listing and its trial or plan includes requests. You can withdraw a waiting request at any time. Businesses are independent of PoolPreCert.
Reviews must be truthful, based on genuine experience, and comply with our Directory & Reviews Policy. We may moderate, refuse, edit for formatting, or remove content that breaches our policies or applicable law.
If you are a pool safety inspector, nothing in PoolPreCert changes your obligations under Chapter 8 of the Building Act 1975 (Qld), including sections 246AA and 246AB once you inspect a pool. Opening a self-check report a homeowner has shared with you is not an inspection.
9. Acceptable use
- Do not use the Platform unlawfully or for fraudulent, deceptive or harmful purposes.
- Do not attempt to gain unauthorised access to accounts, systems or data.
- Do not upload malicious code or content intended to compromise the Platform.
- Do not scrape, harvest or systematically extract directory data without permission.
- Do not impersonate PoolPreCert, an inspector, a government body or another person.
- Do not use AI output to make representations you know or should reasonably know are false.
10. Intellectual property
The Platform, software, branding, interface, documentation and PoolPreCert-created content are owned by or licensed to PoolPreCert and protected by applicable intellectual property laws. Except as expressly permitted, you must not copy, modify, reverse engineer, sell, distribute or commercially exploit our Platform or intellectual property.
11. Fees and subscriptions
Paid plans are governed by the Subscription, Cancellation & Refund Policy. Before purchase, the checkout process will clearly identify the price, billing interval, applicable taxes, renewal arrangements and cancellation method. Prices are in Australian dollars and include GST.
Features that are available at no charge today (for example directory listings and quote requests for pool fence contractors and pool builders) may in future become part of a paid plan. We will tell existing users at least 30 days before any charge starts, and nothing will be charged without you choosing a plan and entering a payment method.
11A. Business accounts
This clause applies if you use PoolPreCert for a business: as an inspector, pool fence contractor, pool builder, real estate agency or property manager.
Your customers' information
You may enter or import information about your customers, tenants, owners and other people (your customer information). You are responsible for it: you must have the right to give it to us, you must tell those people how their information is handled (our Privacy Policy explains what PoolPreCert does with it), and you must only import contact lists you are entitled to use. We handle your customer information only to provide the Platform to you, including sending booking, reminder, quote, invoice and review emails on your behalf when you use those features, and we never use it to market to your customers or sell it. If a customer asks you or us to correct or delete their information, you must act on it and we will help. When you close your account, your customer information is deleted with it, except as the Privacy Policy describes. Agencies must not upload tenants' or owners' personal information, and must be entitled to give us the name and work email of a property manager named in an upload.
Private links
You can create private links that work without signing in (a customer link, an accountant link, a calendar link, a booking link and report links). Anyone holding a link can see what it shows until it expires or you switch it off. You are responsible for who you give a link to: send each link only to the person it is meant for, keep calendar links private, switch a link off when it is no longer needed, and have your customers' permission before you put their details into your own calendar or share them with your accountant.
AI assistant
The AI assistant is included in paid business plans and may be limited or paused (for example by a daily or monthly message limit). It can make mistakes. It drafts quotes and invoices only; nothing is created or sent until you press Confirm, and you are responsible for checking every quote and invoice, including the customer, prices and GST, before you confirm it. Do not enter passwords, card numbers or other people's sensitive information, and only enter customers' details if you have their permission to do so. The assistant is not a pool safety inspector and does not give pool safety, compliance or legal advice.
Inspection records
If you are a licensed pool safety inspector, you are responsible for keeping your inspection records for at least five years as the Building Act 1975 (Qld) requires. PoolPreCert protects completed professional inspection records from deletion inside your account for five years, but if you close your account they are deleted with it. Download your record packs from Records before you ask us to delete your account.
Homeowners who ask for you
Homeowners can ask a listed business to contact them before the business has joined. Until your listing is claimed and your trial or plan includes requests, you can see only a count of the homeowners waiting near the councils you cover. Once your listing is claimed and your trial or plan includes requests, waiting requests (up to 60 days old when you join) are placed in your inbox as ordinary requests, and the same terms about customer information, privacy and withdrawal apply to them. A homeowner may withdraw a request at any time. We do not charge a fee per request.
Reviews of your business
PoolPreCert invites every customer whose request you marked booked or done to review your business, once, with one reminder five days later, whatever the outcome. You cannot switch these invitations off or choose who is invited. You must not ask us to withhold or delay an invitation, ask a customer to change or remove a review, offer anything in return for a review, or ask customers about their satisfaction before they are invited to review.
Quote approved records and connected accounting software
A quote approved record is a note made by the business that approved the quote. PoolPreCert does not check it, is not a party to the quote, the work or the payment, and does not decide whether a quote is fair or valid; only enter details you are entitled to share. If you connect your own accounting software, the customer and invoice details you choose to send are sent under that provider's terms; you are responsible for that connection and can disconnect it in Settings.
11B. Website button
This clause applies if your plan or trial includes requests and you use the Website button. It is in addition to clause 11A. The Website button is part of the plans that include requests; there is no separate charge for it.
What it is
The Website button gives you a link, a QR code, printable material and a simple button that opens the PoolPreCert homeowner self-check. The homeowner does the self-check themselves. It is not an inspection, it is not done by you or by us, and it does not give or replace a pool safety certificate. Only a licensed pool safety inspector can decide whether a pool meets the pool safety standard.
Your wording
You must describe the Website button only as a way for a person to do their own self-check with PoolPreCert. You must not say or suggest, in your button, website, social media, poster, email or anywhere else, that:
- a pool meets, or will meet, the pool safety standard, or will be accepted at an inspection;
- the self-check is an inspection, a pre-inspection, a report or certificate from you, or that you did it;
- PoolPreCert, the QBCC, the Queensland Government or a council has approved, endorsed or checked you, your pool work or any pool.
You must use the button wording, notices and material we supply, and must not change or hide the notice that the self-check is not an inspection. You must not use PoolPreCert's name or logo except as supplied.
If you are a licensed pool safety inspector
Nothing in the Website button changes your duties under the Building Act 1975 (Qld), including sections 246AA and 246AB once you inspect a regulated pool. Do not give a person your view on whether their pool complies, or is likely to comply, based on a self-check result before you have inspected the pool. Reply to a result only to arrange or discuss a booking. If you attend and inspect, you must give a certificate or a nonconformity notice as the law requires.
If you are a pool fence contractor or pool builder
The self-check is not your inspection and you must not offer to check, inspect or approve a pool. You may offer a quote for work. Your own advertising must show your licensed name and licence number as the law requires.
Your website
You must own or control every website address you give us. Put the button only on websites that you own or control and that belong to the business named on your listing. Do not put it in a frame, in a misleading advertisement or on another person's website. We may check where your link is used and may ask you to remove it from a site that is not yours.
People who send you a result
A person who sends you their result has asked you to contact them about the thing they asked for. You may use their details to respond to that request, to quote, to book, and to keep your records of that job. You must not sell or pass their details on, add them to a mailing list, or send them marketing unless they have separately and clearly agreed (for example by a separate tick box) and each marketing message identifies you and has a working way to stop receiving it (Spam Act 2003). You must handle their information as if the Australian Privacy Principles applied to you, keep it secure, and correct or delete it when they ask. The person can withdraw their request at any time and you must then stop using their report.
Reviews, numbers, limits and pausing
If you show PoolPreCert reviews on your own website you must show them as they are, without choosing only the good ones, editing them or offering anything in return; clause 11A (Reviews of your business) still applies. We show you counts of visits and requests so you can see how the button is used; they are approximate, we do not promise any number of visits or requests, and we may change how they are counted. To keep the service fair we limit the number of AI photo checks that homeowners arriving through one link can use in a month (currently 150). If your link is opened from websites you did not list, or is used in a way that looks like misuse, we may pause it and tell you why. A person at PoolPreCert will look again if you email support@poolprecert.com.
When it ends
If your plan or trial that includes requests ends, the link and QR code stop offering to send results to you. Anyone who follows an old link or QR code sees a page that does not name you. You are responsible for removing the button, link, QR code and printed material where you have put them.
12. Consumer rights and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee, warranty, condition or consumer protection that cannot lawfully be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or other applicable law.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the service. If a failure with a service does not amount to a major failure, you are entitled to have the failure rectified within a reasonable time. If this is not done, you are entitled to cancel the contract for the service and obtain a refund of any unused portion, subject to applicable law.
13. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted availability. The Platform may be unavailable for maintenance, security work, upgrades, outages or circumstances outside our reasonable control.
We may add, change or remove features. If a change would remove or materially reduce something you pay for, we will tell you at least 30 days before it takes effect, and you may cancel before then and receive a refund of any amount you have paid for the period after your cancellation. This clause does not limit your rights under the Australian Consumer Law.
14. Suspension and ending access
We may suspend or end your access if it is reasonably necessary to protect the Platform or other users, to prevent fraud or unlawful activity, if you materially breach these Terms, or if a payment has failed and is still unpaid after our reminders and the payment provider's retries (at least 14 days). Except where immediate action is needed for security, we will give you notice and a reasonable chance to fix the problem first, and where practicable a chance to download your data. You may end your account at any time from the Privacy section of Settings. Ending access does not affect rights or obligations that accrued before it ended.
15. Data after termination
After account termination, we may retain information where reasonably necessary for legal, accounting, security, dispute-resolution, fraud-prevention or other legitimate purposes. Otherwise, we will handle deletion, de-identification or decommissioning in accordance with the Privacy Policy and applicable law. Deleted information can remain in database backups for up to 7 days until they expire; until then it is protected and put beyond use.
16. Confidentiality
Each party must take reasonable steps to protect confidential information received from the other and use it only for the purposes of the relationship, subject to disclosures required by law and information that is already public or independently developed.
17. Our liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be excluded, including clause 12. Subject to that sentence:
- if you acquire our services as a consumer for personal, domestic or household use, our liability to you is as set out in the Australian Consumer Law;
- if you acquire our services for business purposes, our liability for a failure to comply with a consumer guarantee is limited, as the Australian Consumer Law permits, to supplying the services again or paying the cost of having them supplied again, and our total liability for any other claim connected with the Platform in any 12-month period is limited to the fees you paid us in that period or $100, whichever is more; and
- neither party is liable to the other for loss of profit or indirect or consequential loss, except where the law does not allow that exclusion.
A self-check, AI photo check or report is information to help you prepare; it is not an inspection, and you remain responsible for engaging a licensed inspector where the law requires one.
18. Indemnity
To the extent permitted by law, you are responsible for losses reasonably suffered by PoolPreCert arising from your unlawful use of the Platform, deliberate misuse, infringement of third-party rights, or material breach of these Terms. This clause does not require you to indemnify us for our own unlawful conduct or for matters that cannot lawfully be shifted to you.
19. Disputes
We encourage you to contact us first so we can attempt to resolve a dispute. Nothing in these Terms prevents you from exercising rights under applicable consumer, privacy or other legislation.
20. Governing law
These Terms are governed by the laws of Queensland, Australia, and the parties submit to the courts exercising jurisdiction in Queensland, subject to any mandatory jurisdiction or consumer protection law.
21. Contact

22. Definitions
AI means artificial intelligence, machine learning or automated analysis used by or through the Platform. Content means photographs, documents, text, property information and other material submitted by a user. Platform means the PoolPreCert website, mobile application, software, reports, services and related functionality.
Updated 22 October 2026: we added the business accounts clause (11A: your customers' information, private links, the AI assistant, inspection records, reviews, quote approved records and accounting software), the inspector Building Act note in clause 8, the rule that features at no charge can only join a paid plan with 30 days' notice, and rewrote clauses 13, 14 and 17 so that changes, suspension and our liability are set out with notice periods and your right to cancel; clause 15 now states the 7-day backup period.
