1. Purpose
This Disclaimer applies to PoolPreCert self-checks, educational content, reports, AI-assisted image analysis, scores, recommendations and other informational outputs.
2. Not a statutory inspection
PoolPreCert does not perform or issue a Queensland statutory pool safety inspection or pool safety certificate. A PoolPreCert report is not a certificate, non-conformity notice or determination by a Queensland pool safety inspector.
- Homeowner self-checks are self-assessments completed by the property owner using PoolPreCert's guided checklist. They may be incomplete or inaccurate.
- Professional inspection records are created by professionals using PoolPreCert. Responsibility for their content rests with the professional.
- Official certification: in Queensland, a pool safety certificate (Form 23) can only be issued by a pool safety inspector licensed by the Queensland Building and Construction Commission (QBCC).
3. Licensed professional inspection
Where a Queensland pool safety certificate or other professional determination is required, you must engage an appropriately licensed pool safety inspector. You should independently verify the inspector's current licence and suitability, for example on QBCC's licence search.
4. AI limitations
- AI can miss hazards or produce false positives.
- AI cannot reliably verify every dimension or legal requirement from a photograph.
- AI cannot reliably test gate self-closing, self-latching, release mechanisms or structural integrity from an image alone.
- Obstructions, lighting, camera angle, image quality, vegetation and hidden defects can affect results.
- Applicable legislation, standards, approvals and property circumstances may change.
- An AI result does not replace professional judgement or physical inspection.
- The AI assistant in paid business accounts drafts quotes and invoices and answers questions with links to official sources. It is not a pool safety inspector, does not give pool safety, compliance or legal advice, and cannot decide whether a pool meets the pool safety standard. Check the sources it links for the current rules.
5. No representation of compliance
Words such as ‘pass’, ‘clear’, ‘looks OK’, ‘no issue identified’ or similar interface labels must not be interpreted as a statutory finding of compliance unless the context expressly states that a licensed professional has made that determination. Homeowner self-checks use labels such as “Looks OK”, “Needs attention” and “Couldn't check”, never “compliant”.
6. User responsibility
The property owner/user remains responsible for obtaining appropriate advice, carrying out required maintenance and repairs, and complying with applicable law.
7. Educational information
Guides and explanations are general information. They are not legal advice and may not cover every property, local-government, building, planning, development approval or historical-standard issue. PoolPreCert's Queensland checklist is based on publicly available guidance from QBCC; the legally binding requirements are set out in Queensland legislation, the Queensland Development Code MP 3.4 and the Australian Standards it references, which may contain detail not reflected in PoolPreCert.
8. Emergency and immediate hazards
Do not use the Platform as an emergency service. If a pool barrier or other condition presents an immediate risk to a child or other person, secure the area, take appropriate immediate safety action and seek qualified assistance.
9. Third-party professionals
Directory listings, profiles, ratings and reviews are provided for convenience. PoolPreCert does not guarantee the quality, availability, licence status, pricing, conduct or work of any listed professional. Verify credentials independently. See our Directory & Reviews Policy.
10. No guarantee of outcome
Use of PoolPreCert does not guarantee that a subsequent professional inspection, local authority assessment or other compliance process will produce a particular outcome.
11. Legal effect
Nothing in this Disclaimer is intended to exclude, restrict or modify rights or remedies that cannot lawfully be excluded under Australian law, including the ACL.
